TAX EVASION

Any competent tax professional will advise that income tax avoidance is legal, but income tax evasion is not. The prosecution would show how much Capone was spending, and compare it to the much lower amount of income he was reporting. Such evidence has been used extensively in Federal narcotics and fraud cases where evidence suggests that people are living far in excess of their declared income. The introduction of tax evasion evidence can be devastating at trial.
