To get a conviction for theft, the State of Florida must prove beyond a reasonable doubt that you knowingly, intentionally and unlawfully obtained or took another individual’s property either permanently or temporarily against their will or without their consent.  The nature, degree, and severity of the charge and punishment of theft are dependent upon the value of what was allegedly taken.  Depending on the value taken, Shoplifting can be charged as a type of Grand Theft.  Often, vehicle theft is charged as Grand Theft as well due to vehicles often being valued at more than $300.

If the value taken was under $300, than you can only be charged with a Misdemeanor charge of Petit Theft.  If the value was over $300 but less than $20,000 than you can be charged with the 3rd degree Felony of Grand Theft.  If the value taken was over $20,000 but under $100,000, than the State can charge you with 2nd degree Felony Grand Theft and if the value was over $100,000 then the charge could be 1st degree Felony Grand Theft.

A 1st degree Felony Grand Theft charge carries with it a MINIMUM MANDATORY SENTENCE of at least 21 months and a maximum of up to 30 years in prison!  However, all other forms of theft charges can result in possible pre-trial programs, restitution, probation, and/or non-state prison.
